End User License Agreement

1. Agreement to Terms

This End User License Agreement ("EULA") is a legal agreement between you and Presail ("we", "us", "our") for the use of the Presail software platform and related services (the "Software"). By creating an account, accessing, or using the Software, you acknowledge that you have read, understood, and agree to be bound by this EULA and our Terms of Service and Privacy Policy. If you do not agree, do not use the Software.

2. License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Software for your internal business or personal security and compliance auditing purposes during the term of your subscription. This is a license to use, not a sale. We retain all right, title, and interest in and to the Software, including all intellectual property rights.

3. License Restrictions

You agree not to, and not to permit others to: (a) copy, modify, or create derivative works of the Software; (b) rent, lease, lend, sell, sublicense, or otherwise transfer rights to the Software; (c) reverse engineer, decompile, or disassemble the Software except to the extent permitted by law; (d) remove or alter any proprietary notices; (e) use the Software to scan applications you do not own or are not authorized to test; or (f) use the Software in any manner that violates applicable law or third-party rights.

4. Your Responsibilities

You are solely responsible for the URLs you submit for scanning and represent that you own or have explicit written authorization to test each application you scan. You indemnify Presail against any claim arising from unauthorized scanning, as further described in our Terms of Service.

5. No Warranty

The Software is provided "as is" and "as available" without warranties of any kind, express or implied. Automated scans are surface-level checks only. They are not a professional security audit, penetration test, or compliance certification under any framework, and they do not guarantee that all vulnerabilities will be detected or that your application is secure or compliant. Scores, badges, alerts, and other outputs are informational only and do not constitute legal advice or a warranty of security or compliance.

6. Limitation of Liability

To the maximum extent permitted by law, Presail and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Software. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

7. Term and Termination

This EULA is effective while you use the Software. We may suspend or terminate your access at any time for violation of this EULA or our Terms. Upon termination, all licenses granted to you cease immediately. You may delete your account and data at any time from your settings.

8. Subscription and Cancellation

Paid plans are billed monthly through Stripe and renew automatically until canceled. You may cancel at any time from the Billing page in your dashboard; cancellation takes effect at the end of your current billing period and access continues until then. Subscription fees are non-refundable except where required by law. See our Terms of Service for full billing and cancellation terms.

9. Changes to This EULA

We may revise this EULA from time to time. Material changes will be notified through the service or by email. Continued use after changes constitutes acceptance of the revised EULA.
