By creating an account or using Presail ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms") and our End User License Agreement. If you do not agree, do not use the service. These Terms apply to all visitors, users, and others who access or use the service.
Presail is a security and compliance auditing platform that scans web applications for common security vulnerabilities, compliance gaps, and configuration issues. Scans are performed on URLs you submit and produce findings and recommendations. Scans are automated, surface-level checks only. They are not a professional security audit, penetration test, or compliance certification under any framework (including GDPR, HIPAA, SOC 2, PCI-DSS, or similar), and they do not guarantee that all vulnerabilities will be detected or that your application is secure or compliant. Scores, the "Presail Cleared" badge, alerts, and any other outputs are informational only and do not constitute legal advice or a warranty, representation, or guarantee of security or compliance. You should not rely solely on Presail for your security or compliance posture.
You may only scan applications that you own or have explicit written authorization to test. You are solely responsible for the URLs you submit and the consequences of scanning them. You agree not to use Presail to scan applications you do not have permission to test, and not to use the service for any unlawful purpose.
You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
Paid plans are billed monthly through our payment processor, Stripe, and renew automatically until you cancel. Subscription fees are non-refundable except where required by law. We may change pricing with reasonable advance notice.
How to cancel: You may cancel your subscription at any time from the Billing page in your dashboard, or by contacting us through the support channel in your dashboard. Cancellation takes effect at the end of your current billing period — you retain access to paid features until then, and no further charges are made.
Authorization for recurring charges: By subscribing, you authorize Presail, through Stripe, to charge your payment method monthly until you cancel. You may change your payment method or cancel at any time; price changes take effect after advance notice.
Your cancellation rights: Consumers in the EU and UK may have a statutory right to withdraw from a subscription within 14 days of purchase; where this applies, contact us to exercise it. California subscribers are notified here that subscriptions auto-renew until canceled and may be canceled at any time as described above. Nothing in these Terms limits any non-waivable consumer rights you may have under your local law.
You agree not to: (a) attempt to access data belonging to other users; (b) reverse-engineer, decompile, or disassemble the service; (c) overload, attack, or interfere with the service; (d) use the service to transmit malware or malicious content; or (e) resell or sublicense the service without our written consent.
Presail and its original content, features, and functionality are owned by us and protected by intellectual property laws. Scan reports generated for your applications are yours to use. You retain all rights to the applications you scan.
The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, uninterrupted, or that it will detect every vulnerability. Security scanning is inherently limited and cannot guarantee complete security. You should not rely solely on Presail for your security posture.
To the maximum extent permitted by law, Presail and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.
You agree to indemnify and hold harmless Presail and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these Terms, or your infringement of any third-party rights. Without limiting the foregoing, you specifically indemnify Presail against any claim or demand arising from your scanning of a URL you do not own or are not authorized to test, consistent with your representation and warranty in Section 3 that you have such authorization.
We may suspend or terminate your access to the service at any time, with or without cause. Upon termination, your right to use the service ceases. You may delete your account and data at any time from your settings.
We may revise these Terms from time to time. Material changes will be notified through the service or by email. Continued use after changes constitutes acceptance of the revised Terms.
If you believe you have found a security vulnerability in Presail, please report it responsibly to security@presail.app or via the contact details in our security.txt file. Do not attempt to access or modify other users' data. We will acknowledge and investigate reports in good faith.
